How Long Is My Divorce Going to Take?

A common concern in divorce cases is how long the process will take. I have developed a flow chart illustrating different options for divorce and how long each step within that option would take. An out-of-court settlement and/or uncontested divorce is significantly less expensive and less adversarial and extremely fast in comparison. It will also allow you to retain more privacy and spare your family emotional detriment. Avoiding litigation can save you months or even years. I can help you complete an uncontested divorce in a matter of weeks. However, I will work with you to achieve a positive outcome should it be necessary for your to resolve a contested divorce in court. Sign a Separation Agreement First

One of the key elements of a quick and easy divorce is signing a separation agreement. In Virginia, couples must be separated for a minimum of one year to obtain a divorce unless they sign a separation agreement. If you sign a separation agreement and you have no minor children, you must be separated for only six months before you can file for a divorce. If you have minor children, you must be separated for one year before you can file for divorce. It is critical that you at least attempt to enter into a separation agreement while you are waiting to file for divorce.
